
The law firm Cheongchul (Attorney in charge: Attorney Bae Gi-hyeong) successfully led to a complete victory in a lawsuit in which a member of a local housing cooperative sued associated parties for damages.
The problematic local housing cooperative project had not been completed even after 10 years since the plaintiff joined the cooperative, and during the process, representatives of the management agency were punished for criminal offenses, making it a situation where the defendant, who mediated the cooperative membership contract, could bear a significant part of the responsibility.
Cheongchul emphasized the principle of the party's burden of proof and the principle of litigation (the fact that the plaintiff has the burden of proof regarding the facts that form the basis of the claim). Additionally, based on the progress of related criminal cases and the responses from relevant institutions, it pointed out that the plaintiff's claims were contrary to the facts. Furthermore, since the plaintiff has not rescinded or canceled the membership contract or withdrawn from the cooperative, it was legally argued that the plaintiff still retains the right to claim the allocation, making it difficult to premise the concept of damage.
The Seoul Southern District Court ultimately accepted all of Cheongchul's arguments and ruled in favor of the defendant, dismissing the plaintiff's claims entirely.
In civil litigation regarding damages, it is crucial to thoroughly examine the claims regarding the appropriateness of the facts, the claims regarding legal principles under the litigation law, and the claims regarding the legal principles under substantive law, and to establish an appropriate litigation strategy accordingly.
