Cheongchul Law Firm (Lead Attorneys: Park Jong-han, Lee Young-gyeong) recently succeeded in defending against all accusations made by the opposing party, who claimed that an important contract had been forged against the client, obtaining a decision of non-prosecution from the investigative agency (police) based on "no grounds for the charges."

  • The client had purchased the disputed land from the opposing party intending to engage in a joint development project; however, the opposing party failed to carry out any legitimate business, leading to issues and eventually resulting in a civil lawsuit between the client and the opposing party.

  • During the ongoing civil lawsuit, the existence of an important contract related to the joint development project that contained unfavorable information for the opposing party was revealed. As the content of this contract became the focal point of the case, the opposing party asserted that the contract was fraudulently forged and proceeded to file a criminal complaint against the client for document forgery.

Cheongchul, in relation to this criminal case,

  1. emphasized that the contract in question bore the seals of both parties and that seal certification was subsequently attached,

  2. noted that the contract did not solely benefit the client but also provided economic advantages to the opposing party,

  3. asserted that considering the relevance and content connection with other contracts, it was clear that both parties had entered into the contract in good faith, and the investigative agency accepted Cheongchul's arguments as they were.

Following Cheongchul's opinion, the investigative agency (police) issued a non-prosecution decision based on “no grounds for the charges.”

In cases of document forgery, it is necessary to examine not only the specific factual relationships surrounding the contract but also the connections with various other disposition documents and materials to comprehensively determine whether the document was created in good faith, necessitating detailed factual reviews and well-prepared arguments.
