
The law firm Cheongchul (Lead Attorneys: Park Jong-han, Lee Young-gyeong) successfully filed a request for injunctions to cancel the real estate disposition prohibition that the opposing party had imposed on the property owned by the client earlier this year; as a result, the opposing party filed an appeal, and we received a decision of full victory in the appeal as well.
The opposing party claimed that the land owned by the client originally belonged to them and that since the land was entrusted in name, it should be returned. They filed for a real estate disposition prohibition on the land and received a judgment in their favor, putting the client, who was developing the land, in a critical situation where they could no longer proceed with land development and sales. Thus, the client asked the law firm Cheongchul to contest the real estate disposition prohibition.
The law firm Cheongchul filed for objection to the injunction in court and received a favorable decision. Although the opposing party filed an appeal regarding their loss, we similarly obtained a judgment that the opposing party's real estate disposition prohibition was unlawful in the appeal.
Regarding the above, the law firm Cheongchul asserted and proved that there was an agreement between the client and the opposing party to jointly develop the property in question and share the profits upon completion of the development project, and the client purchased the property in question from the opposing party; the court accepted Cheongchul's opinion.
The court ruled that the opposing party failed to provide sufficient evidence regarding the rights to be preserved concerning their request for the real estate disposition prohibition and dismissed the opposing party's appeal.
