Attorney Shin Joon-sun from Cheongchul Law Firm conducted an interview with 'CBS No Cut News' regarding the 'prospects for fines and penalties related to personal information leakage incidents.'
Regarding the case where Coupang leaked the personal information of 33.7 million people, there are concerns that the current levels of fines and penalties under the Personal Information Protection Act are low compared to the scale of damage. In particular, given that Coupang's sales last year totaled about 41 trillion won, with over 90% of that coming from domestic sales, discussions on the effectiveness of the existing punitive system are actively taking place.
Attorney Shin Joon-sun stated, "Fines are administrative penalties, and the upper limit is set quite low," adding, "There have barely been cases where fines have been imposed close to the legal maximum." However, he added, "In Coupang's case, considering the scale of damage and the nature of violations, there is a possibility that fines could be set higher than in existing cases."
He continued, "Abroad, there are many cases where punitive damages are applied on a large scale for violations of personal information protection obligations," emphasizing that "the most effective means of regulating companies is ultimately economic sanctions." He also stated, "If the level of fines is made realistic, the immediate penalties will be significant."
