Attorney Kim Kwang-shik interviews with 'IT Chosun' on changes in the IT and gaming industries following the implementation of the Yellow Envelope Law

Attorney Kwang-shik Kim of Cheongchul Law Firm conducted an interview with 'IT Chosun' regarding the changes in organizational operations and labor-management relations in the IT and gaming industries following the implementation of the Yellow Envelope Law.

With the recent implementation of the Yellow Envelope Law (amended Trade Union Act), discussions regarding the scope of liability between parent companies and subsidiaries are expanding. Particularly in the IT and gaming industries, changes are expected across existing organizational operation methods such as spin-offs, subsidiary operations, outsourcing, and reassignments.

Attorney Kwang-shik Kim of Cheongchul Law Firm explained, "The spin-offs, creation of subsidiaries, and reassignments that have frequently occurred in the IT and gaming industries are not immediately illegal in themselves." However, he added, "After the implementation of the amended Trade Union Act, if the parent company or headquarters substantially and concretely dominates and determines the working conditions, it may become difficult to uniformly refuse collective bargaining solely on the grounds that it is under the jurisdiction of a separate corporation or is a managerial decision."

Additionally, he suggested that a close review of and response to labor laws are necessary in the process of corporate workforce management and organizational restructuring.
